Liability Waiver

1. Commitment to Safety
The Studio prioritizes the safety, well-being, and long-term health of all dancers. Instructors are committed to teaching proper technique, safe training methods, and best practices designed to promote longevity in dancers’ bodies and reduce the risk of injury.
However, the Student understands that even with appropriate instruction and supervision, injuries may occur.
2. Acknowledgment and Assumption of Risk
The Student understands that participation in dance classes, rehearsals, conditioning, choreography, performances, competitions, workshops, and related activities involves inherent physical risks. These risks include, but are not limited to:
Muscle strains and sprains
Ligament or joint injuries
Falls
Collisions with other participants
Fatigue or overuse injuries
Slips on dance flooring
Injuries involving props, mirrors, barres, or equipment
The Student voluntarily assumes full responsibility for all risks associated with participation, whether arising from their own actions, the actions of others, the condition of equipment or facilities, or instruction provided.
3. Waiver & Release of Liability
In consideration for being permitted to participate in activities with the Studio, the Student (and Parent/Guardian, if applicable) hereby:
Waives and releases the Studio, its owners, directors, instructors, employees, contractors, volunteers, and agents from any and all claims of liability for personal injury, illness, property damage, or wrongful death arising from participation.
Agrees not to sue the Studio or its representatives for claims arising from participation, including but not limited to claims of improper instruction, negligent teaching, or inadequate supervision.
Understands that this waiver does not apply to claims resulting from gross negligence or intentional misconduct by the Studio.
4. Facilities & Leased Premises
The Student understands that the Studio operates within leased commercial space inside a larger building owned and/or managed by third parties.
Participation may occur:
Within the Studio’s leased premises
In common areas of the commercial building (including hallways, restrooms, entrances, and parking areas)
At off-site venues, including performance spaces, competition venues, workshops, rented facilities, or special event locations
The Student agrees that:
The building owner, landlord, property management company, and any third-party facility providers are not responsible for injuries, damages, or losses occurring during participation.
The Student expressly releases and holds harmless both the Studio and the building owner/management from liability for accidents or injuries occurring on the premises, except in cases of gross negligence or intentional misconduct.
5. Premises & Equipment Acknowledgment
The Student acknowledges that participation includes use of:
Studio dance flooring
Barres and mirrors
Props and choreography equipment
Sound systems and lighting
Lobby and waiting areas
Restrooms and shared common spaces
Parking areas adjacent to the building
The Student assumes all risks associated with movement and activity within these areas.
6. Medical Authorization
The Student authorizes the Studio to obtain emergency medical treatment if deemed necessary. The Student (or Parent/Guardian) agrees to be financially responsible for any medical expenses incurred.
7. Insurance Acknowledgment
The Student understands that the Studio maintains general liability insurance; however, this coverage does not provide health, accident, or medical insurance for participants. The Student is strongly encouraged to maintain personal medical insurance coverage.
8. Indemnification (Minors)
If the Student is under 18 years of age, the Parent/Guardian:
Consents to the minor’s participation.
Agrees to indemnify and hold harmless the Studio from any claims brought by or on behalf of the minor participant.
Assumes financial responsibility for any damages caused by the minor participant.
9. Media Release
The Student grants the Studio permission to photograph and record video of classes, rehearsals, performances, and events. The Studio may use such media for promotional, educational, marketing, and social media purposes without compensation.
If the Student wishes to opt out of media use, written notice must be provided to the Studio.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
11. Acknowledgment & Signature
By signing below, the Student (and Parent/Guardian, if applicable) acknowledges that:
They have read and fully understand this Agreement.
They understand they are giving up certain legal rights.
They are signing voluntarily and without coercion.
This Agreement is intended to be as broad and inclusive as permitted by Colorado law.
